Unabated Violations & Non-Disposed Summonses Continue

1/4/18:

The above link contains some of the evidence kept from the jury while the judge allowed Defendant’s attorney to mislead the jury that the use was all legal. Outrageous! It also evidences the conspiracy by Long Branch officials to enable the private Defendants to evade zoning and other ordinances as long as humanly possible, to Plaintiff’s detriment. The goal – to force Plaintiff’s acquiescence or get him to leave – not happening.

Municipal Court Appears Complicit in Obstructing Justice

11/4/18:

On Sept. 10, 2018, the first court date since the denial of the site plan, Mr. Hayes, on behalf of the new administration,  asks that E&L Paving and Mr. Bruno be dismissed from the matter based upon only owning the properties whereas the Atlantic Paving as lesse/occupant is primarily at fault, which logic the judge readily accepts though carrying the matter for 5 years. The court itself comments that it’s the longest case ever which is why the editor calls it “the longest running play on Broadway”  The court says we are almost there referring to the fact that occupants are to vacate though Mr. Hayes does not spell out for the court what that should look like –  only “that the site be returned to the status quo and at least one company removed” Mr. Turner, however admitted the use, if any,  is to be contained within the garage and the notice of violations and summonses call for all businesses except Atlantic Paving to vacate. Since then Atlantic Paving has filed its subdivision applications no doubt in the hopes of attaining further adjournments from the readily obliging court. Though the courts are used for coercion and settlement in lieu of trials, zoning violations are also to be terminated within 30 days and at some point there is a trial and fines until the defendant submits to justice. Nov. 19 will be telling.

Plaintiff’s business is involved in interstate commerce, and the restricting of access of trucks since 2009 by the neighbors/defendants/ surrogates of the Schneider Administration in order to
extort Plaintiff’s acquiescence thru predicate state offenses of coercion, including arson, to their illegal expansion/use, (see Case(s)/4039-11) also constitutes a federal crime called the Hobbs act, punishable by up to 20 years in federal prison.

The perpetrators by taking over control of access to Plaintiff’s property and interfering with his business have stolen his property rights. As to public officials, the payments can be to third parties and can include campaign contributions reported or otherwise.
“Coincidentally”, after getting the city attorney to admit the fake curbs and self created parking zone (see photos) which restrict access are illegal, and making the police chief aware of the Hobbs act violation, within 2-3 weeks thereafter a loading zone was installed with no parking permitted on one side of the street as counter to the illegal self created parking zone on the other side of the street, which remains.

The administration’s use of all departments to issue dirty permits and help the neighbors evade the law and retaliation including thru the Hobbs Act to attempt to force Plaintiff out of both his manufacturing and realty business (see “New Corruption Uncovered”) for his opposing same, also, is believed to violate the RICO statute. It is believed Plaintiff’s is not the only business that has been subject to racketeering.

At the very least, the above constitute the state crime of official misconduct in which no payment is required.

It is hoped that Federal and State law enforcement will address the obvious criminality before July 1 when mayor Schneider leaves office, having been defeated in the May 8 election. In particular, credibility of FBI and DOJ management has been called into question as of late in the news for becoming politicized. The public expects laws to be enforced without political considerations. It should be mentioned that the new FBI Director, Christopher Wray and the newly appointed local US Attorney, Craig Carpenito both represented former Gov Christie in Bridgegate. Mr. Carpenito served under former US Attorney Christie from 2005-2008 and Christie served under Wray at DOJ..

Hopefully this will not get in the way of enforcing the law. The public should demand that even those leaving office should not be immunized for crimes committed while in office. The public would be well served by demonstration of this fact, which could deter other administrations from same. Failing this, losing the election could be the mayor’s best luck yet.
